Terms of Service

1. Agreement

These terms are between you and Devilos LLC, a Wyoming limited liability company ("we"), which runs nuxter.app. Our registered address is 30 N Gould St, Ste N, Sheridan, WY 82801, United States. They apply whenever you use the site or an account on it. If you don't accept them, don't use the site.

2. Purchases and the kit

The Terms of Sale cover buying a license. The Nuxter Commercial License covers what you may do with the kit. For a license and the kit, those two are the whole agreement, as section 11 of the License says. Nothing here adds to or limits them, and where they and these terms cover the same thing, they win. The Privacy Policy explains how we handle personal data.

3. Your account

You sign in with a link we email to your address, so anyone who can read that inbox can get into your account. Keep it secure, and tell us if you think someone else got in. You must be at least 16 to have an account.

A license goes to the account for the email address you paid with, and we make that account if it doesn't exist yet. Deleting your account does not end a license, but nobody can manage its seats after that. Contact us first if the license should move to another account.

4. Acceptable use

Do not:

break the law, or use the site to harm or deceive anyone;
try to get into accounts, data or parts of the site that aren't yours;
probe, overload or get around the site's security or limits, or send it more automated traffic than a person would;
sign up with an email address you aren't allowed to use;
use your dashboard to give anyone access to the kit that the License doesn't allow.

5. GitHub

The kit lives in a private GitHub repository. Each seat needs a GitHub account, and the GitHub Terms of Service apply to it. We don't control GitHub. If GitHub refuses an invitation, or an account loses access because of GitHub, contact us.

6. Our content

The site, its docs and comparison pages, and the Nuxter name and logo are ours. You may read them, link to them and quote short excerpts with a link back. Anything more needs our written permission. Kit code shown on the site is still part of the kit, and only the License says what you may do with it. Other products named on the site belong to their owners.

What you give us, such as a name, a photo or a licensee name, stays yours. You let us store and show it to run the site.

7. Other services

Payments go through Stripe, repository access through GitHub, and the site runs on Cloudflare. Their own terms cover what they do. That doesn't change what a license gives you (section 8). We aren't responsible for other sites we link to.

8. Changes to the site

We may change, add or remove parts of the site, and it may sometimes be unavailable. None of this changes what a license gives you: read access to the kit repository and every update we publish there, for as long as the license lasts.

9. Suspension and ending

You can stop using the site at any time, and delete your account in its settings. We may suspend or close an account that breaks these terms, or when we must to protect the site or other people, or to follow the law.

Suspending or closing an account does not end a license or its seats' access. A license ends only as section 8 of the License says.

10. Disclaimers and liability

The site's pages are provided as is, without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the extent the law allows. The docs and the comparison pages are information, not legal or professional advice. For the kit itself, sections 9 and 10 of the License apply.

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data, arising from the site. Our total liability to you arising from the site is limited to what you paid for your license.
